Therefore, if you do not agree with the considerations detailed in this Legal Notice, please do not use the Portal, since any use you make of it or of the services and contents included in it will imply the acceptance of the legal terms contained in this text.

The Ministry of Defense-Air Force reserves the right to make changes to the Portal without prior notice, in order to update, correct, modify, add or remove the contents of the Portal or its design. Privacy

The Ministry of Defence is the entity responsible for the data file generated with the personal data supplied by the users of the portal www.defensa.gob.es.

In accordance with Organic Law 15/1999, of 13 December, on the Protection of Personal Data, the Ministry of Defence undertakes to comply with its obligation of secrecy with regard to personal data and the duty to treat them confidentially. To this end, it will adopt the necessary measures to avoid their alteration, loss, treatment or unauthorized access.

The purpose of the collection and automated processing of personal data is to manage, provide, extend and improve the services requested by the user at all times and to follow up on queries made by users.

The Ministry of Defence maintains the levels of protection of your personal data in accordance with Royal Decree 1720/2007, of 21 December, relating to security measures for automated files containing personal data, and has established all the technical means at its disposal to prevent the loss, misuse, alteration, unauthorised access and theft of the data you provide to the Ministry of Defence, without prejudice to the fact that security measures on the Internet are not impregnable.

The Ministry of Defence reserves the right to modify this Privacy Policy in order to adapt it to new legislation, jurisprudence or the interpretation of the Spanish Data Protection Agency. In this case, the Ministry of Defence will announce such changes, clearly indicating in advance the modifications made and requesting, if necessary, your acceptance of such changes.

Applicable law and jurisdiction

The applicable law in case of dispute or conflict of interpretation of the terms that make up this Legal Notice, as well as any issue related to the services of this Portal, will be Spanish law.

For the resolution of any conflict that may arise from visiting the Portal or from the use of the services that may be offered therein, the Ministry of Defence and the User agree to submit to the Judges and Courts of the User's domicile, provided that the latter is located in Spanish territory.

Policy on electronic certificates. Requirements

In order to access the services and procedures of the Ministry of Defence by means of an electronic certificate, you must prove your identity and, in cases where this is required, sign the documents submitted electronically. For these purposes, digital certificates accepted by the General State Administration will be accepted.

Reuse of public sector information

The text of the legal notice contained in the Annex to Royal Decree 1495/2011 implementing Law 37/2007 is included, according to which it must be available in the designated space for reuse, preferably at the electronic headquarters of the corresponding administrative body, organisation or entity.

Obligatory nature of the general conditions

These general conditions, which are permanently available at http://www.datos.gob.es/avisolegal, will bind any reusing agent simply by making use of the documents submitted to them.

Authorisation for reuse and non-exclusive assignment of intellectual property rights.

These general conditions allow the reuse of the documents submitted to them for commercial and non-commercial purposes. Re-use is understood to be the use of documents held by the bodies of the General State Administration and other bodies and entities of the State public sector referred to in Article 1.2 of Royal Decree 1495/2011 of 24 October, which develops Law 37/2007 of 16 November on the re-use of State public sector information, by individuals or legal entities, for commercial or non-commercial purposes, provided that such use does not constitute a public administrative activity. Authorised re-use includes, by way of illustration, activities such as the copying, dissemination, modification, adaptation, extraction, reordering and combination of information.

The concept of document is that established in section 2 of Article 3 of Law 37/2007, of 16 November, on the re-use of public sector information, and therefore includes all information regardless of its material or electronic support, as well as the form of graphic, sound or image expression used, and therefore also includes data at its most disaggregated or "raw" levels.

This authorisation also entails the free and non-exclusive assignment of the intellectual property rights, if any, corresponding to such documents, authorising the reproduction, distribution, public communication or transformation activities necessary to carry out the authorised reuse activity, in any form and under any format, for everyone and for the maximum period of time permitted by law.

General conditions for reuse

The following general conditions for the re-use of documents submitted to them apply:

  • It is forbidden to distort the meaning of the information.
  • The source of the documents subject to re-use must be cited. This citation may be made in the following manner: "Origin of the data: Ministry of Defence".
  • The date of the last update of the documents subject to re-use must be mentioned, provided that it was included in the original document.
  • It may not be indicated, insinuated or suggested that the Ministry of Defence, owner of the reused information, participates, sponsors or supports the reuse carried out with it.
  • The metadata on the date of updating and the applicable conditions for re-use included, where appropriate, in the document made available for re-use must be kept, not altered or deleted.

Exclusion of liability

The use of the data sets will be carried out by the users or agents of the reuse at their own risk, and they will be exclusively responsible to third parties for any damage that may arise from it.

The Ministry of Defence shall not be liable for the use made of its information by the reusing agents nor for the damages suffered or economic losses that, directly or indirectly, produce or may produce economic, material or environmental damage.

The Ministry of Defence does not guarantee the continued availability of the reusable documents, either in content or form, nor does it assume responsibility for any errors or omissions contained therein.

The reusing agent is subject to the applicable regulations on the reuse of public sector information, including the sanctioning regime provided for in Article 11 of Law 37/2007, of 16 November, on the reuse of public sector information.
